1. Scope and Provider

These Terms and Conditions apply to all bookings for tours, workshops, and consulting services provided by MaLo Blue Horizons Consulting SAS.

2. B2C Services: Seaweed Experiences

Applicable to individuals and groups booking guided coastal tours (“Seaweed Safaris”) and culinary workshops.

2.1 Nature of Services & Environmental Factors

  • Scope: The service includes the guided activity as well as digital communication before and after the event.
  • Service Emails: Participants will receive a preparation email (logistics, weather, safety) prior to the event and a follow-up email containing a summary of species, recipes, and contact information for the local seaweed producers and partners featured during the tour.
  • Weather & Tides: All activities take place in a natural environment (“The Intertidal Zone”) and are strictly subject to tide schedules and weather conditions. MaLo Blue Horizons Consulting reserves the right to modify start times or meeting points for safety reasons.
  • Language: Public tours are generally conducted in German. Private tours and workshops in English are available upon request.

2.2 Authority of the Guide (B2C)

For all Seaweed Experiences, the guide acts as the authority on safety. Participants must strictly follow the guide’s instructions regarding tide movements, walking paths, and tasting.

  • Right to Exclude: The guide reserves the right to exclude any participant who ignores safety directions, lacks mandatory footwear (see below), or appears intoxicated, without refund.

2.3 Assumption of Risk:
Participation is at your own risk. The activities take place in a wild, natural environment (“The Intertidal Zone”).

  • Risk of Slipping: Traversing wet rocks and algae requires focus and stable footing. Appropriate footwear (rubber boots or sturdy hiking boots with ankle support) is mandatory.
  • Liability: MaLo Blue Horizons Consulting is insured for professional liability. However, the organizer accepts no liability for minor injuries (scratches, slips, falls) resulting from the participant’s inattention or lack of appropriate gear.

2.4 Dietary Health:
Seaweed is a natural product rich in iodine. Participants are responsible for verifying their own medical compatibility (e.g., thyroid issues, iodine allergies) and should seek medical advice before consumption. Participants must inform the guide of any dietary allergies prior to the workshop.


2.5 Right of Withdrawal
Pursuant to Article L.221-28 12° of the French Consumer Code (Code de la consommation), the statutory 14-day right of withdrawal does not apply to leisure activities provided on a specific date or period. All bookings are therefore final upon confirmation.


2.6 Cancellation Policy (B2C)

For Individual Participants (Public Tours):

  • Up to 48 hours before the event: Free cancellation.
  • Less than 48 hours or “No Show”: 100% of the fee is charged.

For Private Groups & Corporate Bookings:

  • Up to 30 days before the event: Free cancellation.
  • Up to 14 days before the event: 50% of the total fee is charged.
  • Less than 7 days before the event: 75% of the total fee is charged.

Cancellation by the Organizer:
If an event must be cancelled due to severe weather warnings, guide illness, or insufficient participation, participants will be offered a choice between an alternative date or a full refund. Further claims (e.g., travel expenses) are excluded.

3. B2B Services: Consulting

Applicable to corporate clients engaging in Commercial Strategy, Stakeholder Engagement, and Operational Framework services.

3.1 Scope of Work
The specific objectives, deliverables, and timeline for consulting engagements are defined in the individual Statement of Work (SoW) or Proposal agreed upon with the client.

 

3.2 Service Delivery & Liability

  • Nature of Obligation: Unless otherwise specified, MaLo Blue Horizons Consulting provides services on a time-and-material or fixed-price basis as a specialized service provider.
  • No Guarantee of Commercial Outcome: We commit to professional execution based on industry standards but do not guarantee specific commercial outcomes (e.g., specific revenue targets or market shares), unless explicitly agreed to in writing.

4. Intellectual Property

The content, texts, and structure of the website malobhc.eu are the intellectual property of MaLo Blue Horizons Consulting SAS. Photographs are used with permission from their respective authors (see Image Credits in Legal Notice)

5. Legal Notice & Privacy

6. Insurance

MaLo Blue Horizons Consulting SAS holds a Professional Civil Liability policy (Responsabilité Civile Professionnelle) with AXA Insurance, policy number 11455472404.

  • Scope: This insurance covers bodily injury, property damage, and consequential financial loss caused to third parties resulting from professional negligence, error, or omission by the provider during the execution of services.
  • Exclusions: This coverage does not apply to damages resulting from the participant’s failure to comply with safety instructions, the wearing of inappropriate equipment (see Section 2.2), or accidents caused by the inherent risks of the natural environment where the provider has not acted negligently.

7. Commercial Disclosures & Third-Party Recommendations

7.1 Local Producers (Workshop Venues)
Our workshops and tours often take place at the facilities of local seaweed producers (e.g., Marinoë, Scarlette Le Corre). While we highly recommend their products based on quality and local heritage, MaLo Blue Horizons Consulting SAS does not receive any commission or financial incentive from sales made directly at these local venues. Purchases made there are solely at your discretion and support the local producer directly.

7.2 Affiliate Links (Post-Tour Communication)
In our follow-up communication (e.g., emails), we may recommend specific online shops (e.g., in Germany) for sourcing products from the visited producers and others that are not available locally. These links may be “affiliate links,” meaning we may earn a small commission if you make a purchase, at no additional cost to you.

  • Transparency: All such links will be clearly marked.
  • Liability: We accept no liability for the delivery, quality, or return of goods purchased from these third-party online vendors.
